Summary

By subscribing to our services, whether for a demonstration or paid account, users agree to the following terms and conditions. 

1. General

1.1 Users agree that there are inherent limitations in the data and results that can be generated from this data, see Data quality and general disclaimer, Section 3 below.

1.2 All intellectual property on or created by our Websites remains the property of Ambercite Pty Ltd or its related body corporate, and users obtain no interest in this intellectual property by using our Websites, apart from subscribed users obtaining a license purely to reproduce copyrighted material created on this Website when the subscribed user was logged in to the Website, and the subscriber was current at the time they were logged in.

1.3  Ambercite does not warrant that any weblinks created by our Websites will remain current, or that the outputs of this site will not change over time.

1.4  Ambercite reserves the right to make unilateral changes to the Websites.

1.5  Ambercite may provide links to third party Websites. Ambercite does not warrant any of the material found on third party websites, or claim any relationship between Ambercite and the owners of any third party websites. Users need to make their own assessment of the value of the information on these third party websites to their business objectives.

1.5 Users agree to adhere to our Resolving problems and refunds policy,  see Section 2 below.

1.6 Users agree to our Cookies policy, see Section 5 below.

1.7 By subscribing to any Ambercite service, or requesting further information, users have agreed to receive marketing communications from us.  However they have the right to opt out of receiving such information at any time. Users also agree to our Privacy policy, see Section 4 below

1.8 By subscribing to Ambercite or using our Websites, users explicitly agree not to reverse engineer any product, service or Website provided by Ambercite.

1.9 Subscriptions are for the use of the named subscribers only, and cannot be shared outside of the working group of the named subscriber. Please note that we do offer general corporate subscriptions if you would like full access to all or part of a company or organisation.  

1.10 Users agree that they are entering into a contract with Ambercite Pty Ltd, (ABN 71 154 692 707), of Level 10, 161 Collins St, Melbourne, Victoria, Australia, and that this contract and these terms and conditions are to be governed by the laws of the State of Victoria, Australia.

1.11 All opinions posted on the Websites are of the author only, and do not represent the views of Ambercite Pty Ltd.

1.12 Ambercite reserves the right to change the terms and conditions as required for operational reasons. Should such a change, in the opinion of Ambercite, materially affect these terms and conditions, it will email all subscribed users and let them what these material changes are. 

 

2. Resolving problems and our refund policy

At Ambercite, your satisfaction with our service is our highest priority.

Our AmberScope and Ambercite Ai websites are designed to make your patent searching experience as productive as possible, and we invite you to search our help files for online assistance that may help resolve any issues you may experience. Should you not be satisfied with our products we also invite you to contact us directly to discuss any concerns that do arise, and we will do our best to help you to resolve these concerns. This may include working directly with you on your search queries to ensure that our products are being used in an optimal manner.

Whilst our policy is not to provide a refund or replacement if you simply change your mind about our products, we will provide a refund when systemic problems occur, including:

  • you are prevented from using the product by a problem that, if you had known about it, would have led you not to purchase a subscription.
  • the product is significantly different to what we have described to you.
  • the product doesn’t provide what we said it would, and this cannot be easily fixed.

If the problem you experience is not significant, we will attempt to rectify this problem within a reasonable timeframe. If the problem is not rectified within a reasonable timeframe, you can request and we will provide a refund.

Also please note natural and unavoidable limitation in the patent data and patent citation data, as discussed in our Data quality and general disclaimer policy.

 

3. Data quality and general disclaimer

3.1  Ambercite and its products including Ambercite Ai and AmberScope   analyse patent data using statistical techniques that are based on available patent citation and ownership data. These outputs are purely mathematical in nature, and do not take into account the personal or professional opinions of any individuals or associates of Ambercite. These outputs are intended to be used as a tool to help support further analysis, and should not be used by themselves and without professional advice on the relevancy of the outputs to your unique circumstances. Data should not be relied upon to prove, without any further analysis by a qualified professional, any opinion of the value, patentability, validity, freedom to operate or infringement of any patent, patents or inventions.

3.2  Users should also be aware that available patent citation data is imperfect, and this may affect the results of any analysis that is undertaken.

3.3 Users agree to recognise that the data coverage is limited to jurisdictions and patents where Ambercite can obtain patent citation data in a form suitable for further analysis.

3.4 Imperfections and limitations in patent and patent citation data may arise from many sources, including from errors and limitations outside of our control in the citation data that is: supplied by patent applicants to patent offices; discovered and listed by patent examiners; published in an indexable form by patent offices; compiled by our patent data supplier; made available to us in a timely manner; and processed by us in line with other operational requirements.

3.5 This means in particular that you should NOT rely on any of our products for a freedom to operate patent search. While our products can assist with freedom to operate searches, you will always need to base such a search on a more conventional patent searching engine. There are plenty of good patent search engines out there (but you may be able to supplement conventional patent searches by running an AmberScope search on the most relevant patents that you find).

4. Privacy policy


At Ambercite we respect the privacy of individuals and protect personal information. This Privacy Policy outlines how we safeguard your personal information in compliance with the National Privacy Principles contained in the Australian Privacy Act 1988 (Cth) (Privacy Act) and other privacy laws that we are bound by. We may amend or update this policy from time to time.

Collection of your Personal Information
Personal information means any information or opinion about you from which your identity is apparent or can reasonably be established.

We only collect personal information from you which is necessary for conducting our business, providing our services to you and meeting our legal obligations.

We take reasonable steps to ensure that you know why we are collecting your personal information, what we use it for, to whom we disclose it and how you can access it to ensure its accuracy.

Where reasonable and practicable to do so, we collect personal information about you directly from you. We take reasonable steps to protect the personal information which we hold from misuse, loss, unauthorised access, modification or disclosure.

To protect your personal information, we have implemented physical and electronic security measures. Our computer systems can only be accessed by authorised users who have been issued specific user identifiers and passwords.

We take reasonable steps to destroy or permanently de-identify your personal information if it is no longer needed by us. We have in place systems for destroying or de-identifying personal information that is no longer required.

5. Cookies policy

Our Websites, including Ambercite.com and Amberscope.com, use cookies to facilitate your login. Cookies are small data files that are placed on your computer or mobile phone when you browse a website.

If your browser is set to accept cookies, as almost all are by default, we take this, and your use of our websites, to mean that you accept our use of cookies (this is known as “implied consent”).

You can accept or decline cookies at any time by accessing the preference panels from your browser’s main menu (usually found under ‘Edit’, ‘Tools’ or ‘Options’). However, if you choose to remove cookies you will be required to log in upon each use of Amberscope.

The only third party to which we currently link to is Google Analytics in order to gather some anonymised usage statistics that allow us to better understand what you value or what interests you about our content, products or services.
